Terms of Service

By using this application, you agree to these Terms & Conditions. By using Inspection Logging, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service. If you are using the service on behalf of an organization, you confirm you have authority to bind that organization.

These Terms may be updated from time to time. If we make material changes, we will update the date above and post the revised version on this page.

Definitions

"Company", "we", "our", and "us" mean Inspection Logging. "Service" means the Inspection Logging websites, applications, and related support. "You" means the individual or organization that creates an account or uses the Service.

Accounts and Access

  • You must be at least 18 years old or the legal age to form a binding contract in your jurisdiction to use the Service.
  • You are responsible for account credentials and account activity, including activity by invited users.
  • You must provide accurate account and billing information and keep it up to date.
  • You are responsible for assigning user access levels and location-level permissions within your organization.

Billing, Trials, and Plan Changes

  • Paid plans are billed in advance and renew automatically unless canceled.
  • Trials, when offered, convert to paid service unless canceled before trial end.
  • Plan upgrades may take effect immediately; downgrades typically take effect on the next billing cycle.
  • Fees do not include taxes unless explicitly stated.

Cancellation and Termination

  • You may cancel from account settings.
  • Fees are non-refundable except where required by law or at our sole discretion.
  • After cancellation, account data becomes inaccessible and is deleted according to our retention and deletion processes.
  • We may suspend or terminate accounts for misuse, non-payment, legal requirements, or material violation of these Terms.

Acceptable Use

You may not use the Service to break the law, infringe rights, attempt unauthorized access, interfere with system integrity, distribute malware, or engage in abusive behavior toward our team.

Data and Privacy

  • You retain ownership of your organization data.
  • You grant us a limited right to process your data to provide, secure, and support the Service.
  • Our handling of personal information is described in our Privacy Policy.

Intellectual Property

The Service, including software, design, and branding, is owned by Inspection Logging and its licensors. These Terms do not grant you ownership of the Service.

Availability and Service Changes

We may modify features, improve functionality, and maintain the Service over time. We may also suspend or discontinue parts of the Service when necessary for security, legal, or operational reasons.

Third-Party Services

The Service may integrate with or contain links to third-party websites, tools, or services. We do not control and are not responsible for the content, availability, or practices of third-party services. Your use of third-party services is at your own risk and subject to those providers' terms and policies.

Disclaimers and Liability

The Service is provided on an "as is" and "as available" basis, without warranties to the maximum extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

You are solely responsible for complying with all local, state, and federal laws, regulations, codes, inspection requirements, and recordkeeping obligations that apply to your business, locations, assets, and operations. Inspection Logging does not guarantee regulatory compliance and is not responsible for your organization's failure to follow applicable requirements.

Indemnification

You agree to indemnify, defend, and hold harmless Inspection Logging, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Texas, and you consent to the personal jurisdiction of such courts.

Dispute Resolution

Before filing a formal legal claim, you agree to contact us through in-app Support to attempt to resolve the dispute informally. If the dispute is not resolved within thirty (30) days, either party may pursue formal proceedings as permitted under the Governing Law section.

To the fullest extent permitted by law, any disputes will be resolved on an individual basis, and you waive the right to participate in a class action, collective action, or representative proceeding.

General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Inspection Logging regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Changes and Contact

If you continue to use the Service after updated Terms become effective, you accept the revised Terms. Questions about these Terms can be sent to our support group using the in-app Support form.
